Client Terms and Conditions

These Terms and Conditions govern the provision of property management services by Living Word International Ltd T/A Spit and Polish Property Management ("we", "us", "our") to the client ("you", "your").

1. Services

We may provide services including:

  • Property inspections

  • Maintenance coordination

  • Contractor management

  • Property checks

  • Tenant liaison

  • Emergency response coordination

  • Property administration and reporting

Specific services will be detailed in a written proposal, quotation, management agreement, or service schedule.

2. Client Authority

By instructing us, you confirm that:

  • You are the legal owner of the property or authorised to act on behalf of the owner

  • Information supplied is accurate and complete

  • Necessary permissions have been obtained where required

3. Property Access

You authorise us and our appointed representatives to access the property where reasonably necessary to perform agreed services.

We will take reasonable care when accessing the property.

4. Maintenance and Repairs

Where maintenance issues are identified:

  • We may obtain quotations on your behalf

  • We may coordinate contractors following your approval

  • Emergency works necessary to protect persons or property may be authorised without prior approval where immediate action is reasonably required

You remain responsible for all repair and maintenance costs unless otherwise agreed in writing.

5. Contractors

We may engage independent contractors to carry out works.

Contractors are responsible for their own workmanship, insurance, licences, and compliance obligations.

We are not liable for defects, delays, or failures caused by third-party contractors except where resulting from our negligence.

6. Fees and Payment

Fees will be set out in our quotation, proposal, or service agreement.

Invoices are payable within 30 days unless otherwise agreed.

Late payments may incur statutory interest and recovery costs permitted by law.

We reserve the right to suspend services where accounts remain overdue.

7. Client Responsibilities

8. Reports and Recommendations

We will provide services with reasonable skill and care.

Our total liability arising from any claim relating to services shall not exceed the fees paid by the client during the previous twelve months.

We shall not be liable for:

  • Loss of profit

  • Loss of rental income

  • Business interruption

  • Indirect or consequential losses

  • Acts or omissions of third-party contractors

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot legally be excluded.

10. Confidentiality

12. Termination

Either party may terminate services by giving 30 days' written notice unless otherwise agreed.

Immediate termination may occur where:

Outstanding fees remain payable upon termination.

13. Force Majeure

Neither party shall be liable for delays caused by events beyond reasonable control, including natural disasters, utility failures, government actions, industrial disputes, or other unforeseen circumstances.

14. Governing Law

For services contracted through the UK branch, these Terms are governed by the laws of England and Wales.

For services contracted through the Cyprus entity, these Terms are governed by Cyprus law.
